Model Call Terms and Conditions

1. Parties Involved:

   • This agreement (the "Agreement") is entered into between Stacey Talijancich, hereinafter referred to as the "Photographer," and the individual responding to the model call, hereinafter referred to as the "Model."

2. Photography Session:

   • The Model agrees to participate in a photography session conducted by the Photographer. The purpose of this session is for the creation of photographic images.

3. Image Usage:

   • The Photographer reserves the right to use the images resulting from the photography session for marketing purposes, including but not limited to portfolio, website, social media, and promotional materials. The Photographer may also submit the images for awards and competitions organized by recognized industry entities, such as the New Zealand Institute of Professional Photography (NZIPP).

4. Compensation:

   • In consideration for the Model's participation, the Photographer agrees to provide the Model with three (3) high-resolution digital images from the session. These images are for personal use by the Model and may not be sold or otherwise distributed for commercial purposes.

5. Additional Image Purchase:

   • The Model may have the option to purchase additional digital images from the session at a mutually agreed-upon rate. Details regarding the number of additional images available and the associated cost will be provided by the Photographer.

6. Release and Waiver:

   • The Model hereby releases and discharges the Photographer from any and all claims and demands arising out of or in connection with the use of the images, including any and all claims for libel or invasion of privacy.

7. Copyright:

   • The Photographer retains all copyright to the images and may use the images for any purpose, including but not limited to advertising, promotion, and sale of prints.

8. Confidentiality:

   • Both parties agree to keep confidential any information shared during the photography session that is not public knowledge.

9. Cancellation and Rescheduling:

   • In the event of unforeseen circumstances, either party has the right to cancel or reschedule the photography session. Notice of cancellation or rescheduling must be provided as soon as possible.

10. Governing Law:

    • This Agreement shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the New Zealand courts.

11. Amendments:

    • This Agreement may be amended only in writing and signed by both parties.

By participating in the photography session, the Model acknowledges that they have read and understood the terms and conditions outlined in this Agreement.
